Fire NOC for a Factory in Gujarat: Authority, Self-Certification Rules and Process
In Gujarat, a factory's fire clearance is a fire safety certificate issued by the Regional Fire Officer or the Chief Fire Officer under the Gujarat Fire Prevention and Life Safety Measures Act, 2013. An enrolled Fire Safety Officer is part of the regime, and self-declarations accompany the application. Whether your factory needs a certificate depends on its classification in the state's schedule.
Which law and which authority
The Gujarat Fire Prevention and Life Safety Measures Act, 2013 is the statute. As summarised from the Act, section 18 puts the duty to provide and maintain fire prevention and life safety measures on the owner or, where the owner cannot be traced, the occupier. Section 19 bars the grant of an occupancy certificate unless those measures are in place, and allows the fire officer to serve a notice on existing buildings requiring them. Section 21 deals with the fire safety certificate: the Regional Fire Officer, the Chief Fire Officer of a local authority's fire service, or a nominated officer examines compliance and may issue it. A certificate can be cancelled after a hearing if directions are ignored.
Rules and regulations under the Act carry the detail. The Gujarat Fire Prevention and Life Safety Measures Rules, 2014 were amended in 2021 and again in 2024, and separate Regulations, 2023 describe the application and approval process. We have not been able to read the gazetted text of all of these directly; the points below are drawn from the Act and from published summaries of the rules, and we say where that limits what we can state.
Does your factory need a certificate?
Not every building needs one. The state's compliance portal guide, as reported, says a certificate is mandatory only for the building types listed in a schedule, and others may follow self-compliance. A 2021 amendment replaced that schedule, and the 2023 Regulations apply to the buildings in it. The schedule groups buildings by occupancy and by height or floor area, and storage and hazardous occupancies appear in it. We could not confirm the exact threshold for an industrial shed, so do not assume your factory is in or out. Ask the fire office, or have a consultant classify the building against the current schedule. Even where no certificate is required, the duty to provide and maintain fire measures under section 18 applies.
The process, stage by stage
| Stage | What happens | Documents and notes |
|---|---|---|
| 1. Fire safety plan approval | Before development permission for a covered building, the plan is submitted to the Regional or Chief Fire Officer | Fire drawings and layout; the 2023 Regulations reportedly set a 21-day decision period |
| 2. Installation | Fire fighting and detection systems installed, by a licensed agency as the Act requires for fire prevention work | Licensed agency's work records, equipment test certificates |
| 3. Application for the certificate | Before occupation, the owner applies with the compliance papers and self-declarations | Reportedly includes declarations on maintenance, a fire equipment maintenance contract and electrical safety |
| 4. Inspection and issue | Fire officer checks and issues the certificate or rejects with reasons | Reported validity of three years under the 2023 Regulations; confirm |
| 5. Declarations during validity | Annual and periodic declarations, with the Fire Safety Officer's reports | False declaration is an offence; keep records |
| 6. Renewal | Apply at least two months before expiry; renewal is reported as valid for two years | The 2024 amendment added the two-month rule and a renewal form |
The periods in the table are as reported by legal summaries, not read from the gazette. Treat them as a checklist of what to confirm.
The Fire Safety Officer regime
Gujarat uses enrolled Fire Safety Officers. Under section 12, for buildings specified by a state order, the owner or occupier must appoint an officer with the prescribed qualifications; the officer is enrolled by the fire service and reports compliance. A 2021 amendment requires appointing one at least two months before the certificate expires to renew it, from the list the Director enrols. If an owner does not appoint one, the fire officer may take action, which the Act says can include reporting to the Labour Commissioner for closure of a factory. Private officers were empanelled from January 2021 to handle periodic inspection, testing and renewal, as reported. As reported on the Regulations, the officer cannot be someone who installed the building's fire measures, to avoid a conflict of interest. Choose the officer early; this is a person you will work with every year.
Fire NOC and the factory licence
Gujarat's Labour Department has issued orders on whether a fire NOC must accompany an application for a factory licence under the Factories Act. A notification in November 2020 was reported as requiring the NOC with new and renewal applications. A later order, reported in February 2022, dispensed with the requirement while the state resolved how NOCs for industries are issued. We have not seen either in the gazette, and which one now governs is for you to confirm with the Directorate of Industrial Safety and Health. The licensing question is also separate from the fire certificate: the Fire Act's duties and penalties apply regardless. Our guide to the factory licence and DISH approval shows how the factory-licence process is built in other states, and the Fire NOC guide for Punjab, Haryana and UP shows how procedures differ.
What the fire system must contain
The Act defines fire prevention and life safety measures by reference to building bye-laws, the National Building Code and other applicable law. For a factory that means detection and alarm, portable extinguishers, hydrants and hose reels, sprinklers or other suppression where the occupancy and storage demand it, a fire pump and water storage, escape routes and signage. For process areas, additional protection depends on hazards. A fire-fighting scheme designed against the code is the document the fire officer examines, so design it before the building is finished. Our fire fighting systems page covers the design and installation.
How Secured Engineers helps
We design fire protection in-house, and Fire NOC, CEIG and DISCOM net-metering applications are filed in-house. In Gujarat the filing involves licensed agencies and enrolled Fire Safety Officers under the state system, and we would agree with you at the start who does what. Our published Gujarat work is MEPF for an office block at a fabrication facility in Anjar, Kutch, completed in November 2025, where approvals and the Fire NOC stayed with the client; this article is not drawn from a Gujarat NOC filing. We work from offices in Noida (Delhi NCR) and Ludhiana, and the company has completed 535+ projects across 18+ states, with 89.77% repeat clients.
If you have a file in preparation, or a notice from the fire office, send it for a review before you file. See our Fire NOC assistance page, message us on WhatsApp or call +91 70099 85817, or ask for a free file review.
Frequently asked
Who issues the fire NOC for a factory in Gujarat?
Under the Gujarat Fire Prevention and Life Safety Measures Act, 2013, the fire safety certificate is issued by the Regional Fire Officer, the Chief Fire Officer of the local authority's fire service, or an officer nominated for the purpose. The state fire service runs an online process, so check the current portal and the office with jurisdiction over your site.
Does every factory in Gujarat need a fire safety certificate?
Not necessarily. A certificate is required for the building types listed in the state's schedule, which was replaced in 2021, and others are expected to self-comply. We could not confirm the threshold for an industrial shed, so ask the fire office or a consultant to classify your building. The duty to maintain fire measures applies either way.
What is the Fire Safety Officer and do I need one?
A Fire Safety Officer is a person enrolled by the state fire service to inspect and certify fire measures and make declarations. The Act requires owners or occupiers of buildings specified by a state order to appoint one, and renewal of a certificate needs one. Whether your building is specified depends on its classification, so confirm with the fire office.
How often must the fire certificate be renewed?
Published summaries of the 2023 Regulations and the 2024 amendment say a certificate is valid for three years and renewals for two, with applications at least two months before expiry. We have not verified these periods against the gazette, so check the current rules before relying on them, and diarise the date well ahead.
What happens if a factory has no fire certificate?
The Act provides for notices to provide the measures, sealing and disconnection of utilities where a notice is ignored, and penalties including imprisonment and fines for listed contraventions. It also lets the fire officer report an owner who does not appoint a Fire Safety Officer to the Labour Commissioner. Take legal advice if you have received a notice.
