Fire NOC vs Fire Licence vs Fire Safety Certificate: What Each Document Is
A fire NOC is the fire authority's approval at plan stage: it accepts your fire design before you build. A fire safety certificate, or final NOC, is issued after inspection and confirms the installed systems match that design. A fire licence is a separate permit, under some state laws, to run particular premises. Each state's Act decides which it issues and under what name.
How do the three documents differ?
Think of them as three questions the fire service asks in order. Is the design right? That is the NOC, or the provisional approval. Was it built as approved? That is the fire safety certificate, the final NOC or the clearance certificate. May these premises operate, and for how long? That is renewal, a periodic declaration, or in some states a licence. The names change; the order does not. The table shows how several states label each step, from the texts and department pages we read.
| State | At plan stage | After construction | To keep operating |
|---|---|---|---|
| Delhi | Fire safety recommendations, often called the NOC, with the building plan | Fire Safety Certificate before occupancy, now issued by an empanelled Fire Safety Auditor | Online declaration in Form K every year, since the 2025 amendment rules |
| Bihar | Provisional No Objection Certificate | Final No Objection Certificate | Renewal: three years for non-residential, two for hazardous buildings |
| Maharashtra | Provisional Fire Safety Approval | Final Fire Safety Approval, supported by Form A from a licensed agency | Maintenance certificate (Form B) in January and July |
| Tamil Nadu | NOC on the building plan and fire plan | Fire licence for the premises, which needs a copy of the NOC | Licence renewal |
| Karnataka | No Objection Certificate | Clearance certificate | Clearance renewal certificate |
| Punjab | Provisional Fire Safety Certificate | Final Fire Safety Certificate | Periodic returns under the 2024 Act |
| Haryana | Approval of the fire-fighting scheme | Fire safety certificate after inspection | Renewal and an annual self-declaration under the 2022 Act |
| Uttar Pradesh | Fire Safety Certificate for the classes the Act lists | Supported by a compliance certificate from a qualified agency | Maintenance certificate twice a year |
Laws change and some of these rows depend on rules still being notified, so treat the table as a map and read the Act and rules for your state before you file.
What is a fire NOC, and what does it not cover?
A plan-stage NOC approves paper. The fire officer reads your drawings against the National Building Code and the state rules and tells you which systems the building must carry: hydrants, sprinklers, detection, pumps, tank, exits. In Bihar the rules call it advice for keeping the building safe from fire. In Delhi the department's own FAQ says the recommendations stay valid only until there is an addition, alteration or revision of the approved plan.
It does not certify the installed system, and it does not say the plant may start production. Owners who treat the NOC as the finish line arrive at occupancy with systems that were never tested for a certificate. Our guide to the drawing set that approvals need shows which drawings feed it.
What is a fire safety certificate, and who issues it?
The certificate comes after inspection. It confirms that the installed systems match the approved scheme and work. Delhi's 2025 amendment rules, published in the Delhi Gazette on 26 May 2026, changed who can sign it: the owner engages an empanelled Fire Safety Auditor, who inspects, reports in Form J and issues the certificate in Form H. The rule adds that this does not absolve the owner of the primary responsibility for keeping the systems in order, and an auditor may not audit a building for which their firm provided design, installation or maintenance. The earlier FAQ gave three years for non-residential buildings; under the amended rule the certificate remains valid subject to the Form K submission each year.
In Maharashtra the Act makes the owner responsible for obtaining the approvals, and fire-system work and Forms A and B must come from a licensed agency. That is one reason the word licence causes confusion there: the licence belongs to the contractor, not the building.
What is a fire licence, and when does it apply?
A fire licence is permission to use premises for a stated purpose. Tamil Nadu is the clearest example in the states we looked at. The Tamil Nadu Fire and Rescue Services issues an NOC on the building plan and a separate fire licence under the Tamil Nadu Fire Service Act, 1985, and the licence file asks for a copy of the NOC. TNFRS publishes the list of premises, storage and transport activities that need a licence, so check your storage, boilers and chemicals against it.
Other permits that owners also call licences are different instruments: the PESO licence for storing petroleum or diesel (see PESO licence for diesel storage), the factory licence under the Factories Act (see factory licence and DISH approval), and the consent of the pollution board. None of them replaces a fire document, and a fire document replaces none of them.
Which do you need, and when?
- New factory: the plan-stage document before construction and the final certificate before occupancy, in whatever form your state uses.
- Expansion, mezzanine, new racking, change of use: go back to the fire authority first. Approvals are tied to the approved plan and occupancy, and Bihar's rules say a change in category needs a fresh certificate.
- Existing factory with an old certificate: check the validity and the renewal window on the certificate itself; do not rely on a general rule. Bihar asks for the renewal application 45 days before expiry, and Delhi's old rules asked six months ahead.
- A state not in the table: start from the state fire service's website and the Act, and ask which documents your building class needs.
The state guides on the site cover the north in detail: Fire NOC for factories in Punjab, Haryana and Uttar Pradesh, and the fire NOC glossary entry.
How Secured Engineers helps
We design fire fighting systems in-house and file Fire NOC applications in-house, together with CEIG and DISCOM net-metering filings. MEPF and solar can be one contract, so the fire scheme, the electrical supply to the pumps and the building services are drawn together. Our offices are in Noida (Delhi NCR) and Ludhiana. We have 535+ projects across 18+ states and 89.77% repeat clients. We do not sell fire safety audits; we review your existing file and rectify what the review finds.
If you already hold an NOC, a certificate or a licence, send us the file and the approved drawings and we will tell you which stage you are at, what is due and what a change would reopen. Start from our Fire NOC assistance page, message us on WhatsApp, call +91 70099 85817, or ask for a free proposal.
Frequently asked
Is a fire NOC the same as a fire licence?
No. A fire NOC approves your fire design at plan stage. A fire licence, where a state issues one, permits you to use the premises or carry on an activity, and in Tamil Nadu its application asks for a copy of the NOC. Several states issue no document called a licence at all and use a fire safety certificate instead. Read your state's Act to see which it uses.
Do I need a fire safety certificate if I already have an NOC?
Usually yes. The NOC approves the design before construction, while the certificate, final NOC or clearance is issued after inspection of the installed systems and is normally needed before occupancy. The exact names and stages differ by state. If your state issues only one document, it is the plan-stage approval, and you should ask the fire office what follows.
How long does a fire safety certificate stay valid?
It depends on the state and the building. Bihar's rules give three years for non-residential and two for hazardous buildings, with renewal applied for 45 days before expiry. Delhi's amended rules keep the certificate valid subject to an annual online declaration. Read the validity and conditions on your own certificate and diarise the renewal date.
Who can issue a fire safety certificate in Delhi now?
Under the Delhi Fire Service (Amendment) Rules, 2025, the owner engages an empanelled Fire Safety Auditor from the Delhi Fire Service portal, who inspects, files an inspection report and issues the certificate for buildings that need fire clearance. The Service may inspect a sample, and the auditor may not have designed, installed or maintained the systems. Check the notification date and in-force provisions.
Does Secured Engineers issue fire safety audits or certificates?
No. We do not sell audits and we do not issue certificates; the fire authority or its empanelled auditor does. We design the systems, prepare and file the NOC application, and review an existing file for gaps, then rectify what the review finds. That separation keeps our design work independent of any audit of it.
