A factory in Bihar needs a Fire Prevention and Fire Safety No Objection Certificate from the State Fire Service if any floor exceeds 500 sq m, or if the building is 15 m or taller. The Bihar Fire Service Rules, 2021 issue it in three stages: a provisional certificate before construction, a final certificate before occupancy, and a renewal. Applications go through the state's online fire NOC portal.

Does your factory need a Fire NOC in Bihar?

Rule 15 of the Bihar Fire Service Rules, 2021 lists the buildings that must obtain the certificate, by reference to Part 4 of the National Building Code, 2016. For a factory, two entries matter. The first covers multi-storey buildings of 15 m and above, or buildings with ground coverage above 500 sq m on any floor. The second covers special buildings, a class that names industrial, storage and hazardous occupancies, where one or more floors exceed 500 sq m.

In practice a single-storey shed of 600 sq m is in. A 400 sq m workshop with one floor and no storage mezzanine may fall outside the list, but the rules also let the Service ask for fire audit and compliance where a building that needed the certificate was built without one. If your plant sits near a threshold, add the mezzanine, the stores and the boiler room to the floor area before you decide you are exempt. For the national code your drawings will be read against, see our guide to NBC 2016 fire and life safety for factories.

The three stages, validity and renewal

The Rules say the certificate is given at three stages of the building's life. The table sets them side by side, as printed in the 2021 rules.

StageWhen you applyWhat the Service looks atNotes from the rules
Provisional NOCBefore construction startsBuilding plan with fire safety systems marked, the checklist and your undertakingsTreated as advice for keeping the building safe from fire; builder reports progress one week before work starts and every six months after
Final NOCAfter construction, before occupancyInstalled systems checked against the provisional adviceThe Service sits on the committee that considers the occupancy certificate
Renewal45 days before expiryInspection and maintenance of the systemsThree years for non-residential buildings; two years for hazardous buildings; the Director General may change the period at renewal

Two further rules shape the project. The certificate is valid only for the occupancy class, occupant load and details in your application, so a change in the building category needs a fresh certificate. And the Service can cancel a certificate for poor maintenance, after which the building may not be used for public or commercial purposes; an appeal lies within 90 days.

How the online portal works

The Service runs an Online Fire NOC and Audit portal at firenoc.bihar.gov.in, with a track-status page and a fire officer login. Schedule D of the 2021 rules describes the filing sequence, which the portal follows in outline:

  1. Choose the type of certificate: provisional, final or renewal.
  2. Fill the application format and upload the scanned building plan, the checklist and the undertaking.
  3. Submit and keep the slip that shows your unique ID, date and time.
  4. Send the hard copies of all documents to the office of the Director, State Fire Service, quoting the ID. Schedule D says the slip is void otherwise and you must apply again.
  5. Watch the status page for objections, rectify them online, and download the certificate when it is issued.

The Schedule says the certificate is uploaded within 15 days if all requirements and queries are in order. Treat that as the Service's own standard, not a promise for your file: every objection stops the clock. The rules were printed with an older web address and a hard-copy step, so confirm on the portal today whether both still apply.

Documents and fees to plan for

Schedule D and Form B list what goes in with a provisional application. The list below is from the 2021 rules; the portal's own checklist is the final word.

  • Application in Form B, routed through the architect or engineer enrolled with the building department or local authority.
  • Two sets of building plans at not less than 1:200, signed by a qualified civil or structural engineer, the architect and the owner or builder, showing the abutting street, occupancy of each floor, staircases, corridors and lifts.
  • Two sets each of the site plan with open spaces marked, floor plans with the fire safety systems marked, terrace plan, sections, elevations, and two sections through the stairs.
  • A typed checklist in Form C, without corrections.
  • Affidavits and undertakings in Form D: compliance with the NBC, the Bihar Building Byelaws, 2014 and the Act; maintenance of fire equipment; staff training and mock drills; periodic fire audit.
  • An estimate of the fire protection system, with a bank guarantee for 15% of that estimate for five years. This is the item owners overlook; it ties up money against the systems you promise to keep in working order.
  • The fee, which Schedule C sets per square metre of total floor area including basements, by building category. For storage, industrial and hazardous buildings the printed rates are 10 for the provisional certificate and 5 each for the final certificate and renewal, in rupees per sq m. The Government can revise these, so check the current schedule.

Where factory files in Bihar usually stall

Most delay is in the drawing, not the portal. Four patterns recur on industrial files in any state, and the Bihar rules make each costly:

  • Fire scheme drawn late. The plan is uploaded with sprinkler or hydrant symbols that have no pump room, tank or ring main behind them. The estimate for the bank guarantee then moves when the real design arrives.
  • Hazard grade assumed. NBC separates low, moderate and high hazard industrial occupancies. Solvents, packaging stock or dust push a plant up a grade, and hazardous buildings carry the shorter two-year validity.
  • Progress reports forgotten. Rule 15 expects notice a week before construction starts and a report every six months. A missing report is an easy objection at the final stage.
  • Changes after approval. A mezzanine, a racking block or a new process line changes the occupancy details the certificate was issued on. Raise it before building it, not at renewal.

Our note on why industrial fire NOC applications get delayed goes through the same causes with examples. The design behind the file is described on our fire fighting systems page.

How Secured Engineers helps

We design fire fighting systems in-house and file Fire NOC applications in-house, alongside CEIG and DISCOM net-metering filings. MEPF and solar can sit under one contract, so the fire scheme, the pump room and the electrical supply for the pumps are drawn together. We work from offices in Noida (Delhi NCR) and Ludhiana, with 535+ projects across 18+ states and 89.77% repeat clients. For a Bihar plant we mobilise from those offices. Our sector guide to Fire NOC for factories in Punjab, Haryana and Uttar Pradesh shows how we structure the file elsewhere.

Send us the draft application, the plan set and the checklist, and we will tell you what the Service is likely to query before you submit. Start from our Fire NOC assistance page, message us on WhatsApp, call +91 70099 85817, or ask for a free proposal.

Frequently asked

Is a Fire NOC compulsory for a small factory in Bihar?

The Bihar Fire Service Rules, 2021 make the certificate compulsory for industrial, storage and hazardous buildings where one or more floors exceed 500 sq m, and for buildings of 15 m and above or with ground coverage above 500 sq m. A very small unit below those lines may not be listed, but the Service can still audit a building and require fire safety measures. Confirm with the district fire station before treating a unit as exempt.

How long is a Bihar Fire NOC valid?

Under the 2021 rules the final certificate is valid for three years for non-residential buildings and two years for hazardous buildings, and the Director General can change the period at renewal. The renewal application is due 45 days before expiry, so diarise it well ahead. Read the validity off your own certificate, because the issuing office sets the date.

Do I still have to send hard copies after applying online?

Schedule D of the 2021 rules says the applicant must submit hard copies of all requirements to the office of the Director, State Fire Service, quoting the unique ID printed on the online slip, or the slip becomes void. The rules were published with an older portal address, so check on firenoc.bihar.gov.in or at the State Fire Office whether the hard-copy step is still in force.

What is the bank guarantee in a provisional NOC application?

With a provisional application the owner gives an estimate for the fire protection system and a bank guarantee for 15% of that estimate for five years, with an undertaking to keep the systems effective. If they are not kept in working order the Fire Department may use the guarantee to restore them. Budget for it when you plan the project's finance.

What happens if I build without the NOC?

The rules empower the Director General or an authorised member of the Fire Service to take notice of a building that needed the certificate but did not obtain it. The Service conducts a fire audit, instructs the builder to put the required measures in place and informs the concerned authority. A cancelled certificate also bars use of the building for public or commercial purposes, so it is cheaper to file first.
